Terms of Service

1. Acceptance of Terms

By accessing or using ThumbRank (the “Service”) at thumbrank.io or any related subdomains, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of the Service

ThumbRank is a software-as-a-service (SaaS) platform that surfaces trending YouTube thumbnails ranked by view count and allows users to filter by tag, category, and channel. The Service depends on the YouTube Data API v3 and is subject to YouTube’s own Terms of Service (https://www.youtube.com/t/terms).

3. Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under your credentials. Notify us immediately at hello@thumbrank.io if you suspect unauthorized access.

4. Subscriptions, Billing, and Payment

Paid plans (Pro and Studio) are billed in advance on a monthly or annual basis. Payment processing is handled by Paddle.com Market Limited (“Paddle”), our Merchant of Record. By subscribing, you agree to Paddle’s terms as applicable to your region.

• Currency. All prices are listed in U.S. dollars (USD). Your bank may apply foreign-transaction fees depending on your country.
• Auto-renewal. Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. You can cancel from your account settings or by contacting us.
• Taxes. Sales tax, VAT, GST, and other transaction taxes are collected and remitted by Paddle where required by law.

5. Refunds

Refund requests are governed by our Refund Policy, which is incorporated into these Terms by reference.

6. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Scrape, resell, or redistribute ThumbRank data or derived rankings without written permission.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to harass, abuse, or harm any person, or to send unsolicited communications.
• Attempt to bypass rate limits, authentication, or any security measure.
• Use the YouTube Data API in ways that violate the YouTube API Services Terms of Service or YouTube’s branding guidelines.

7. Intellectual Property

The Service, including its design, code, branding, and aggregated analytics, is owned by ThumbRank and protected by intellectual-property laws. You retain ownership of any data you submit (e.g. saved searches).

YouTube, the YouTube logo, and YouTube thumbnails are trademarks of Google LLC. ThumbRank is not affiliated with, endorsed by, or sponsored by YouTube or Google.

8. Third-Party Services

The Service relies on the following third parties:

• YouTube Data API v3 (Google LLC) — provides video metadata.
• Paddle — payment processing and tax handling.
• Supabase (database + auth) — stores account, subscription, and usage data.
• Vercel — hosts the application and runs serverless functions.

Your use of these services is subject to their respective terms and privacy policies.

9. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may cancel your account at any time by contacting us. Upon termination, your right to use the Service ends immediately.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE DATA PROVIDED (INCLUDING YOUTUBE METRICS) IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBRANK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

12. Governing Law

These Terms are governed by the laws of the Republic of Honduras, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the courts of Honduras, unless applicable consumer-protection law in your jurisdiction grants you the right to bring proceedings in your local courts.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top will reflect the most recent change. Material changes will be communicated by email or by an in-app notice. Continued use of the Service after a change constitutes acceptance of the updated Terms.
